Basildon and Thurrock University Hospital faces prosecution over the death of a severely-disabled patient.
Kyle Flack from Stanford-le-Hope was found dead at Basildon University Hospital, on 12 October 2006.
His head had become trapped in the rails surrounding his bed.
The Trust is charged with failing to ensure the patient’s safety under the Health and Safety at Work Act 1974.
The first hearing will take place at Basildon Magistrates’ Court on Friday 22 January.
