Beauty by Zara in Grays fined thousands over beauty products with mercury

THE OWNER of a Grays beauty shop has been fined thousands for selling beauty products that contained “a prohibited substance namely mercury”.

Beauty by Zara Limited of 24 Clarence Road, Grays and the companies director, Imran Ahmed Bashir, of Grosvenor Gardens, London, pled guilty at Basildon magistrates court to a number of charges (see below).

Bashir and Beauty by Zara Limited were fined £2,649.00

Bashir pled guilty to the following:

1. At 20/24 Clarence Road, Grays, Essex failed to act with due care in relation to applicable requirements of regulation (EC) No 1223/2009 by making available on the market a cosmetic product which contained a prohibited substance namely mercury in breach of article 6(1) and article 14(1)(a) of Regulation (E) No 1223/2009, the said offence having been committed with your consent or connivance, or as a result of your negligence, in your capacity as a director of said company..

2. At 20/24 Clarence Road, Grays, Essex failed to act with due care in relation to applicable requirements of regulation (EC) No 1223/2009 by making available on the market a cosmetic product which contained a prohibited substance namely mercury in breach of article 6(1) and article 14(1)(a) of Regulation (E) No 1223/2009, the said offence having been committed with your consent or connivance, or as a result of your negligence, in your capacity as a director of said company..

3. On 10/03/2016 at 20-24 Clarence Road, Grays supplied or offered to supply or exposed or possessed a good for supply, a cosmetic product prohibited by safety regulations namely the product ‘Rinju Total Beauty Dry Skin Therapy Smoothing Lotion 1000ml’ where the container or packaging of that product failed to display the name and address of the manufacturer or responsible person within the EAA, the date of minimum durability and batch
number of the manufacturer, the said offence having been committed with your consent or connivance, or as a result of your negligence, in your capacity as a director of the said company. contrary to regulations 12(2) and 24(2) of the cosmetic products enforcement regualtions 2013.

Beauty by Zara Limited pled guilty to the following:

1. At 20/24 Clarence Road, Grays, Essex failed to act with due care in relation to applicable requirements of regulation (EC) No 1223/2009 by making available on the market a cosmetic product which contained a prohibited substance namely mercury in breach of article 6(1) and article 14(1)(a) of Regulation (E) No 1223/2009, the said offence having been committed with your consent or connivance, or as a result of your negligence, in your capacity as a director of said company..

2. At 20/24 Clarence Road, Grays, Essex failed to act with due care in relation to applicable requirements of Regulation (EC) No 1223/2009, by making available on the market cosmetic products, as set out in the attached schedule ‘A’ having reason to believe they were not in conformity with the requirement of Regualtion (EC) No 1223/2009 due to the absence of an EEA address of a responsible person, the date of mininum durability or the use of incorrect names on the ingredient list, in breach of Article 6 (3) and 19(1) of Regulation (EC) No 1223/2009.

3. On 10/03/2016 at 20/24 Clarence Road, Grays supplied or offered to supply or exposed or possessed a good for supply, a cosmetic product prohibited by safety regulations namely the product ‘Rinju Total Beauty Dry Skin Therapy Smoothing Lotion 1000ml’ where the container or packaging of that product failed to display the name and address of the manufacturer or responsible person within the EAA, the date of minimum durability and batch number of the manufacturer. contrary to Regulation 12(2) of the cosmetic products enforcement regulations 2013.
