A MAN escaped jail despite refusing to provide a specimen of breath for a breath test on what led to be his third conviction for drinking and driving.
Andrius Malciauskas, 30, Jetty Walk, Grays was stopped by police in Grays on the 18th December, last year.
The court at Basildon magistrates, heard that he refused to provide a breath test.
Malciauskas had two previous convictions dating back to 2005 and 2006.
Pleading guilty, Malciauskas asked for leninecy saying he had lost his job as a driver due to this.
Chair of magistrates, Mrs Harper banned him from driving for three years and issued a community order for 18 months.
Do these magistrates actually believe that a driving ban will be upheld by this person, this is his third Drink Driving offence and is obviously a habitual offender, take away the licence completley and crush any vehicle that he owns either that or put a custodial sentence in place.
The excuse he has given for leniency is a poor one, if he was that concerened about his job he would not be behind the wheel whilst drunk.
