Noisy Neighbours Punished

A Chadwell St Mary woman has been convicted at Basildon Magistrates Court on Tuesday (29 September) and a Grays man at Grays Magistrates Court, on Thursday (24 September) for failing to comply with a noise abatement notice.

There was no evidence that Samantha Cole of Ruskin Road, Chadwell St Mary, had taken reasonable steps to stop her dog from barking on 1 April 2009 and she had no reasonable excuse for not doing so.

Miss Cole had received three conditional discharges in February 2009 for three similar offences and had breached these discharges and sentenced for both the current matter and the matters from February.

She received a fine of £150, a victim surcharge of £15 and a contribution to prosecution costs of £150 to be paid in instalments of £20 fortnightly.

She is also on a benefit reduction order which has been increased to £10 a week collection.

Lee Fenwick of Whitehall Lane, Grays admitted that he did not take reasonable steps to ensure that amplified music was not played in breach of the abatement notice against him.

He received a £300 fine, a £15 victim surcharge and was ordered to pay costs of £185.
